Dashes in square brackets indicate unclear words or letters. indicate words the author inserted to a previously written line.] (Black History Month) MSS SC 1147 - Parish of Feliciana (LA) Bill of Sale Number of Pages: 3 ----- new page (MSSSC1147_p001.jpg) THE STATE OF LOUISIANA PARISH OF EAST FELICIANA BE IT KNOWN, That this day, before me, HENRY HAWFORD, a Notary Public in and for the Parish of East Feliciana, State of Louisiana, aforesaid, duly commissioned and sworn, PERSONALLY CAME AND APPEARED Dewed C Hardee and William Sandel Administrator of the Estates of Wade H Gaulden deceased and Ana M Gaulden declared of saw Nariph of Earn Fliciana WHO DECLARED, That for and in consideration of the sum of Nine hundred and sixty five dollars lawful money of the United States, payable in the manner prescribed below, They do grant, bargain and sell unto Doctor Fleming P Duggins also of and Parish of the other part, (said party being present and accepting,) the following described Negros Ver: Negro woman names "Jane" and her child "Philip" being the same which was bid off by the said Dr. Fleming P. Duggin at a public sale of said Wade H Gaulden's Estate on this 24th February 1852 made by Augustin J Law Sheriff of East Feliciana in virtue of an order from the Honorable Seventh District COurt, in and for said Parish of East Feliciana, in suit numbered on the docket of the suits of said Court, No. 703 and entitled "In the matter of the succession of Wade A Gaulden [---]" after due notices by public advisements, for which the said Hardee V Sandel Administrator have received the said Dr Fleming P Duggins note dated the 24th February 1852 payable twelve months after date with eigth per cent per annum from this date with Clemens Gore security which note in amounts $965 has been paraphed "the varieter" by one notary to identify the same herewith to have and to hold the above named slaved Jane & Philip to the said Doctor Fleming P. Duggins his heirs and assigns, to this own proper use, benefit and behoof, forever. And the said Hardee V Sandel Administrator the said Slaves to the said purchaser, his heirs and assigns, shall and will warrant and forever defend by these presents from any incumbrance on the part of the said Wade A. & Ann M Glauden deceased and no other person. ----- new page (MSSSC1147_p002.jpg) AND FOR THE PURPOSE OF SECURING THE SAID Hardee V Sandel Administrator in the true and lawful payment of the above-mentioned notes, or sums of money, at the time the same shall become due, the said Doctor Fleming P. Duggins doth by these presents, mortgage and hypothecate unto the said Hardee V Sandel Administrator the above described and named slaves "Jane" and "Philip" until the full and final payment of said sums of money, and all interest that may accrue thereon. And the said Dr. Fleming P. Duggins doth further AGREE AND CONSENT, That this mortgage and hypothecation shall operate as, and have the full force and effect of a final judgment rendered in a court of competent jurisdiction within the State of Louisiana. And the said Dr. Fleming P. Duggins doth further COVENANT AND AGREE, not to mortgage, sell, alienate, donate, convey, or otherwise encumber, deteriorate, or dispose of the slaves Jane & Philip herein conveyed, to the prejudice of Cre[---] of the said Wade/ & Gaulden deceased THUS DONE AND PASSED, at [---] Parish of East Feliciana this twenty fourth day of February A.
